This Privacy Policy (“Privacy Policy”) sets out how Fizztein, Inc., a Delaware corporation (the “Company,” “Fizztein,” “we,” “us,” or “our”), collects, uses, discloses, and protects information that you (referred to as “you” or “your”) provide or that is collected when you access, browse, create an account on, purchase Products through, or otherwise use the website located at https://www.drinkfizztein.com (the “Website”), or when you otherwise interact with Company, including by contacting our customer support team, signing up for marketing communications, engaging with Company on social media, or doing business with Company as a retailer, distributor, or other wholesale customer (collectively, the “Services”).

Fizztein develops, markets, and sells FIZZTEIN, a sparkling protein seltzer beverage (the “Products”), directly to consumers through the Website and to retailers and other business customers on a wholesale basis. The Website is hosted on and operated through the Shopify e-commerce platform. This Privacy Policy applies to all Personal Information collected through the Website and Services. It does not apply to information collected by third-party retailers that sell Products in their stores or on their own websites, which is governed by those retailers’ privacy policies.

Company is committed to ensuring that your privacy is protected. Any Personal Information (as defined below) you provide when using the Website and/or Services will only be used in accordance with this Privacy Policy. This Privacy Policy should be read together with Company’s Terms and Conditions and Disclaimers, each available on the Website.

What Personal Information is Collected?

“Personal Information” means information that identifies, relates to, describes, or is reasonably capable of being associated with you or your household. When browsing, purchasing, or otherwise accessing the Website or engaging with Company for any of the Services, you may be asked to provide, or Company may collect, the following categories of Personal Information:

Account Credentials: if you choose to create an account, your username, password, and other information used to create and access your account. Creating an account is optional.
Order and Transaction Information: the Products you purchase, order history, order totals, shipping method, delivery status, discount codes used, and records of refunds or store credits issued.
Payment Information: payment card or other payment method details, which are collected and processed directly by Shopify and its payment processing partners. Company does not receive or store your full payment card number.
Customer Support Information: the content of your communications with our customer support team, including emails, messages, order numbers, and photographs you submit in connection with a damaged Product request or other inquiry.
Product Feedback and Adverse Reaction Reports: if you contact Company to report a concern about a Product, including a suspected allergic reaction or other adverse experience, the information you choose to provide. Company uses this information only to respond to you, investigate Product quality and safety, and comply with its legal obligations.
Wholesale and Business Information: for retailers, distributors, and other business customers, the business name, contact person, title, business address, phone number, email address, tax or resale certificate information, and purchasing and payment history.
User Content: reviews, ratings, photos, videos, comments, and other content you submit on the Website or post on social media while tagging or mentioning Company.
Marketing Preferences: your subscription status for email and SMS communications and your interactions with those communications, such as whether you open an email or click a link.
Device Information and Identifiers: IP address, cookie IDs, browser type and language, operating system, and device type.
Connection and Usage Information: pages and Products viewed, time spent on pages, referring website, search terms entered on the Website, items added to your cart, and other information about how you interact with the Website.
Approximate Geolocation: city, state, and ZIP code derived from your IP address or shipping address. Company does not collect precise geolocation information.
Social Media Information: if you interact with Company on Instagram, TikTok, Facebook, or other social media platforms (together, the “Third-Party Platforms”), information made available to Company based on your privacy settings, such as your username, profile photo, and comments.

Company does not intentionally collect sensitive Personal Information, such as Social Security numbers, government identification numbers, or precise geolocation, and does not collect or use health information other than what you voluntarily provide when reporting a Product concern as described above. Please do not send Company sensitive information about your health or medical history beyond what is necessary to describe your concern.

How is Personal Information Collected?

Generally, you are not under any statutory or contractual obligation to provide Company any Personal Information; however, certain Personal Information is required to place an order, and some Personal Information is collected automatically when you use the Website. Company collects Personal Information from the following sources:

Directly from you: when you place an order, check out as a guest, create an account, sign up for marketing communications, submit a review, contact customer support, submit a damaged Product request, or apply to become a wholesale customer.
Automatically: through cookies, pixels, and similar technologies when you browse the Website or open Company’s emails, as described in the “Does the Website use Cookies?” section below.
From service providers and third parties: including Shopify, shipping carriers (for delivery status), analytics providers, advertising partners, and Third-Party Platforms.

How do you get my Consent?

By providing any Personal Information through the Website, including placing an order, creating an account, submitting a contact form, or subscribing to marketing communications, you consent to the collection, storage, and use of that information for the purposes described in this Privacy Policy. Where required by applicable law, Company will obtain your express consent before collecting or using your Personal Information for a particular purpose, including before sending you marketing text messages.

How do I Withdraw my Consent?

You may also unsubscribe from marketing emails at any time by clicking the “unsubscribe” link in any marketing email, and from marketing text messages by replying STOP.

Company reserves the right to retain information previously collected to the extent required by law or for legitimate business purposes, including completing pending orders, processing refunds, resolving disputes, enforcing agreements, maintaining tax and accounting records, and responding to Product recalls or safety issues. Withdrawing your consent may affect Company’s ability to process your orders or provide certain Services.

How is your Personal Information used?

Company may use your Personal Information for the following purposes:

To process, fulfill, ship, and deliver your orders, and to send order confirmations and shipping updates.
To process payments through Shopify and to detect and prevent fraudulent transactions, unauthorized resale, and chargeback abuse.
To create and manage your account, if you choose to create one.
To respond to customer support requests and review and resolve damaged Product requests, refunds, and store credits.
To investigate Product concerns, and to contact you in the event of a Product recall, market withdrawal, or safety notice.

How is your Personal Information shared and disclosed?

Company does not sell your Personal Information for money. Company may share and disclose your Personal Information as follows:

Service Providers: with vendors that perform services on Company’s behalf, as described in the “Third-Party Service Providers” section below. These providers may use your Personal Information only as necessary to perform services for Company.
Shipping Carriers and Fulfillment Partners: your name, shipping address, telephone number, and order details, as necessary to deliver your order.
Advertising and Analytics Partners: device identifiers, usage information, and similar data collected through cookies and pixels, as described in the “Behavioral Advertising” section below.
Professional Advisors: with Company’s attorneys, accountants, auditors, and insurers, as necessary to obtain professional advice or services.

Third-Party Service Providers

Company engages the following third-party service providers, among others, in connection with the operation of the Website and Services:

Shopify: website hosting, e-commerce platform, checkout, and payment processing. Shopify’s privacy policy is available at https://www.shopify.com/legal/privacy.
UPS: delivery of orders.
Klaviyo: email and SMS marketing communications. Order notifications are sent through Shopify.
Google Analytics: Website analytics.
Meta (Facebook and Instagram): social media and advertising.

Each of these providers maintains its own privacy policy and data practices. Company encourages you to review the applicable privacy policies of these third-party services.

Does the Website use Cookies?

Yes. Company, Shopify, and other third parties use cookies and similar technologies (for example, HTTP cookies, pixels, web beacons, and embedded scripts) on the Website and in Company’s emails. Cookies are small files placed on your device through your web browser that allow the Website to recognize your browser or device and remember certain information. Company uses the following types of cookies:

Strictly Necessary Cookies: required for the Website to function, such as keeping items in your shopping cart and processing checkout. These cannot be disabled through the Website.
Preference Cookies: remember your settings and preferences for future visits.
Analytics Cookies: compile aggregate data about Website traffic and interactions so that Company can improve the Website.

Because there is no uniform standard for responding to Do Not Track signals, the Website does not currently respond to them. However, Company honors Global Privacy Control (“GPC”) signals as a valid request to opt out of the sale or sharing of Personal Information for targeted advertising, where required by applicable law.

Behavioral Advertising

Company may use your Personal Information, including information collected through cookies and pixels, to provide you with targeted advertisements or marketing communications that Company believes may be of interest to you. Communications To You; Email and SMS

If you place an order or contact Company, Company will send you transactional communications about your order, such as order confirmations, shipping notifications, and responses to your inquiries. If you opt in, Company may also send you marketing emails, including newsletters, new flavor announcements, and promotional offers. You may opt out of marketing emails at any time by clicking the “unsubscribe” link in any such email. Even if you opt out of marketing emails, Company will continue to send you transactional communications relating to your orders.

If you opt in to receive text messages, Company will send recurring automated marketing and informational text messages to the mobile number you provide. Consent to receive marketing text messages is not a condition of purchase. Message frequency varies, and message and data rates may apply. You may opt out at any time by replying STOP. Company does not share mobile telephone numbers or text messaging opt-in data with third parties or affiliates for their own marketing purposes. Text messaging consent and phone numbers are shared only with service providers that help Company operate its text messaging program.

How is your Personal Information Protected?

Company takes the security of your Personal Information seriously and implements reasonable administrative, technical, and physical safeguards designed to protect it. Checkout and payment information is transmitted over encrypted connections and processed by Shopify, which maintains compliance with the Payment Card Industry Data Security Standard (PCI DSS). Access to your Personal Information is limited to Company personnel and service providers who need it to perform their duties. If you create an account, you are responsible for keeping your password confidential. No method of transmission over the internet or electronic storage is completely secure, and Company cannot guarantee absolute security.

Retention of your Personal Information

Company will retain your Personal Information only for as long as reasonably necessary for the purposes set out in this Privacy Policy, including to fulfill orders, maintain your account, process refunds and credits, respond to Product safety matters, and comply with legal, tax, and accounting obligations. When Personal Information is no longer needed, Company will delete or de-identify it. Company may retain aggregated or de-identified information that cannot reasonably be used to identify you.

Does Company Collect Information from Minors?

The Website and Services are intended for individuals who are at least eighteen (18) years of age, and Products may only be purchased through the Website by individuals eighteen (18) years of age or older. The Website is not directed to children under the age of thirteen (13), and Company does not knowingly collect Personal Information from children under the age of thirteen (13). If Company learns that it has collected Personal Information from a child under the age of thirteen (13), Company will promptly delete such information. How do I access, correct, or delete my Personal Information?

You can access and update certain account information by logging in to your account. You may also request to access, correct, update, or delete your Personal Information by contacting Company at support@fizztein.com. Company will take reasonable steps to verify your identity before responding to your request. Please note that Company may retain certain information as required by law or as necessary for legitimate business purposes, including records of prior purchases, refunds, and tax information. Residents of certain states have additional rights, as described in Section III below.

Third-Party Links

The Website may contain links to third-party websites, including retail partners, Third-Party Platforms, and Shopify. These third parties have separate and independent privacy policies. Company has no responsibility or liability for the content and activities of these third parties. Nonetheless, Company seeks to protect the integrity of the Website and welcomes any feedback about these third-party links.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU ACKNOWLEDGE AND AGREE THAT UNDER NO CIRCUMSTANCES WILL COMPANY BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES CAUSED OR ALLEGED TO BE CAUSED IN CONNECTION WITH YOUR USE OF THE WEBSITE OR SERVICES, INCLUDING WITHOUT LIMITATION LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, OR LOSS OF DATA, EXCEPT TO THE EXTENT SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.

Acceptance of Terms

UNITED STATES USERS ONLY

Company is headquartered in the United States, sells Products only within the United States, and operates the Website for users located in the United States. If you access the Website from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country of residence.

STATE SPECIFIC PRIVACY RIGHTS

Depending on where you live, and subject to the applicability thresholds and exceptions under your state’s law, you may have certain rights regarding your Personal Information. Company will honor the requests described in this Section to the extent required by applicable law.

California Residents

California Consumer Privacy Act. The California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), provides California residents with the right to: (a) know the categories and specific pieces of Personal Information Company has collected about them, the sources of that information, the business purposes for collecting it, and the categories of third parties to whom it is disclosed; (b) request deletion of their Personal Information; (c) request correction of inaccurate Personal Information; (d) opt out of the sale or sharing of their Personal Information; (e) limit the use and disclosure of sensitive Personal Information; and (f) not be discriminated against for exercising their privacy rights. The categories of Personal Information Company collects, the sources of that information, the purposes for which it is used, and the categories of recipients are described in Section I above. Company does not use or disclose sensitive Personal Information for purposes that would give rise to a right to limit under the CCPA.

“Do Not Sell or Share My Personal Information.” Company does not sell Personal Information for money. However, California law broadly defines “sale” and “sharing” in a way that may include allowing advertising partners to collect device identifiers, cookie data, and browsing information through the Website for targeted advertising. In the preceding twelve (12) months, Company may have shared the following categories of Personal Information in this manner: device information and identifiers; connection and usage information; and approximate geolocation. You may opt out by clicking the “Do Not Sell or Share My Personal Information” link on the Website, by enabling GPC in your browser, or by contacting Company at support@fizztein.com. Company does not knowingly sell or share the Personal Information of consumers under sixteen (16) years of age.

Shine the Light. California residents may request, once per calendar year and free of charge, a list of the third parties to which Company has disclosed certain Personal Information for those third parties’ own direct marketing purposes during the preceding calendar year. Residents of Other States

Residents of certain other states, including Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, may have some or all of the following rights under their state’s consumer privacy law, subject to applicable thresholds and exceptions:

If Company declines to take action on your request, you may appeal the decision by emailing support@fizztein.com with the subject line “Privacy Request Appeal” within a reasonable time after receiving Company’s response. Company will respond to your appeal within the time required by applicable law. If your appeal is denied, you may contact the Attorney General of your state.

Nevada Residents

Nevada law allows Nevada consumers to opt out of the sale of certain Covered Information (as defined under Nevada law) for monetary consideration. Company does not sell Covered Information as defined under Nevada law. Nevada residents may nevertheless submit an opt-out request by contacting Company at support@fizztein.com.

How to Submit a Privacy Request

To exercise any of the rights described in this Section, please contact Company at support@fizztein.com with the subject line “Privacy Request,” and include your name, the email address associated with your orders, your state of residence, and the right you wish to exercise. Company will verify your request by matching the information you provide with information in its records, and may request additional information where necessary. You may designate an authorized agent to submit a request on your behalf, and Company may require proof of the agent’s authorization and verification of your identity. Company will respond to verified requests within forty-five (45) days, or within any other timeframe required by applicable law, and may extend this period where permitted. Company will not discriminate against you for exercising any of your privacy rights.

Updates and Changes to this Privacy Policy

Company may update or change this Privacy Policy from time to time to reflect changes to its practices, the Website, or applicable law. When Company makes changes, it will revise the “Last Updated” date at the top of this Privacy Policy. If Company makes material changes to how it uses or discloses Personal Information, Company will provide notice on the Website and, where appropriate, by email before the changes take effect. Please review this Privacy Policy periodically.
